Abstract
Comments on Alexander Devine Children's Cancer Trust v Housing Solutions Ltd (SC) on the application of the "contrary to public interest" ground under the Law of Property Act 1925 s.84(1)(aa) and 84(1A)(b) to an application to discharge a restrictive covenant after its deliberate breach by a developer's construction of affordable housing on the site. Highlights the court's approach to the relevance of such a breach and the implications.
