The cultural sensitivity in harmonisation of international arbitration: lessons from China
Analyses the role of cultural considerations in cross-border arbitration, with reference to China's approach. Examines the interaction between arbitration and culture, arbitration's role in the context of Chinese culture, and how the hybrid system of mixed mediation and arbitration is produced by cultural pluralism. Reviews the theory of the global harmony of arbitration, and whether judicial interaction will lead to a common arbitration culture.
