Abstract
The paper addresses the objections often made, implicitly or explicitly, that social welfare (also known as social-economic) rights are not justiciable because of the fiscal implications that they carry. The paper compares this argument to the parallel claim, that is easily rejected by the courts, where civil and political rights are concerned
