Abstract

This essay examines the way in which Social Services of General Interest are regualted in EU secondary law through a new governance process of soft law communications emanating predominantly from the European Commission and through the use of exemptions, exclusion or special treatment in EU secondary law. It argues that the EU is creating a fragemented system of regulation but the European Commission plays a central role in creating a normative framework to regulate an area of law outside of EU legislative competence.
