Considers reforms to the French insolvency law regime introduced by Law 2005-845 of 26 July 2005 on the Preservation of Enterprises, focusing on the impact on lender liability. Discusses the background to, and key elements of, the traditional doctrine of soutien abusif (improper support). Summarises the provisions limiting liability for supplies of credit, noting exceptions in cases of fraud, deliberate interference in the management of the debtor company or guarantees which are disproportionate to the credit supplied.
