Abstract

Considers the extent to which a comprehensive legal order in insolvency has been created in the EU. Assesses the existing insolvency instruments, focusing on: (1) the core insolvency work concerning the regulation of insolvency proceedings, including Council Regulation 1346/2000 and European Parliament and Council Directives 2001/17 and 2001/24; and (2) the insolvency-related work dealing with the area as ancillary to a main subject-matter, including employment law and company law.
