Abstract

Explores the economic and legal reasons why insolvency has become an issue of concern within the EU. Looks at: (1) the legal bases on which instruments have been discussed or enacted in the UK, including private international law and company law harmonisation initiatives, judicial cooperation in civil matters, sector-specific provisions on the freedom of establishment and the freedom to provide services, and internal market measures and residual powers; and (2) the case for further harmonisation.
