journal contribution
posted on 2023-06-07, 21:07 authored by Paul Omar
Analyses the influences of French upon English insolvency law, including the move towards consolidation of insolvency law in the early to mid 19th century, the role of the Official Receiver and of official insolvency administrators, and the 20th century adoption of a corporate rescue culture using corporate voluntary arrangements and administration, and vice versa, including the introduction of the sauvegarde procedure and of creditors committees. Considers how both countries have been influenced by other systems, including EC law and the US Code Title 11 Ch.11 and how they will develop in future.
